Minnesota Eviction Moratorium Phaseout Timeline
On day 1, June 30, 2021 – Landlords can evict for:
- Serious endangerment;
- Significant damage to property;
- Violations of 504B.171 (illegal drugs, guns, prostitution, and stolen property); AND for
- Nonpayment of rent IF THE RESIDENT:
- Refuses to apply for assistance through the COVID-19 emergency rental assistance program;
- Refuses to provide information needed by the landlord to apply for assistance on the resident’s behalf; or refuses to provide the landlord with proof that the resident applied for assistance through the program.
- Refuses to provide the landlord with proof that the resident applied for assistance through the program.
On day 15, July 14, 2021 – Landlords can evict for material violations of the lease other than nonpayment of rent.
On day 75, September 13, 2021 – Landlords can evict for nonpayment of rent IF the resident is ineligible for COVID-19 emergency rental assistance.
Terminations and Non-Renewal Notice Evictions
On day 1, June 30, 2021 –Landlord can issue termination notices and non-renewal notices for:
- Serious endangerment;
- Significant damage to property;
- Material violations of the lease other than nonpayment of rent
- At the request of a resident
On day 45, August 13, 2021 – Landlord can issue termination notices and non-renewal notices for:
- Residents who owe rent who are ineligible for rental assistance through a COVID-19 emergency rental assistance program.
On day 106, October 13, 2021 –Landlord can issue termination notices and non-renewal notices for:
- End of lease
- Month-to-month tenancies – 30 day (Minn. Stat. § 504B.135(a))
- Month-to-month tenancies – 14 day Non-payment of rent (Minn. Stat. § 504B.135(b))
Notice to vacate for any reason other than those listed above (under June 30, 2021) cannot be given until the off-ramp period ends on 10/12/21.
